Working Dogs and their tails.I know that there are rules that govern the Showing of docked dogs but what exactly is the situation regarding the likes of a docked dog competing in a Trial? There are no entry fees paid by spectators but I understand we might be caught by the fact that a monetary prize might mean that the dog was working " for gain" and therefore be caught by the act. I apologise if this is already covered somewhere but if it is I must have had a TOG moment.

Dogs competing in trials are ok - any form of gundog work is ok. At least that's how I've understood it.

I understood that trials are fine as they are working dogs.

| Quote: | (9) A person commits an offence if—
(a) he shows a dog at an event to which members of the public are
admitted on payment of a fee,
(b) the dog’s tail has been wholly or partly removed (in England and Wales
or elsewhere), and
(c) removal took place on or after the commencement day. |
| Quote: | (10) Where a dog is shown only for the purpose of demonstrating its working
ability, subsection (9) does not apply if the dog is a subsection (3) dog. |
| Quote: | (11) It is a defence for a person accused of an offence under subsection (9) to show
that he reasonably believed—
(a) that the event was not one to which members of the public were
admitted on payment of an entrance fee,
(b) that the removal took place before the commencement day, or
(c) that the dog was one in relation to which subsection (10) applies. |

I take it this is the get out clause.

No, always. You can always show a dog if it is docked and demonstrating its working ability, docked now or after the commencement date.
This clause covers displays - as at gamefairs - of gundogs working.
There are no restrictions on what you can do with dogs which have been docked before - they can still be shown at conformation shows forever, as they have been docked before the ban.

Do you commit an offence if you dock the pups yourself, irrespective of if they are going to be "shown" or not?
|

Yes, you do already at the moment in the UK, even before any of this legislation. All pups have to be docked by a vet.
